the primary loan is 334k, I have about 165k equity in it<br />
Whne I refied my mortgage broker also advised to pay off all remaining debt on my credit record<br />
I had been saddled with a late relatives CC debt when they died and being the authorized used the credit carc company (HSBC) passed on the debt to me (The relative&#8217;s lawyer shouldve payed it)<br />
I disputed it with HSBC but they refused to remove it.<br />
So World Savings broker told me they would be paying off this old debt and a few other late collections of around 700 dollars.<br />
Well in November of this year I had an accident, emergency home repairs and perfect storm of bad stuff happen.<br />
I went to world savings for home equity line of credit. They told me Wachovia has bought them, but with my 165k in home equity i would get the line of credit&#8217;EASILY&#8217;<br />
they dragged their heels and finally a month later sent me a letter denying me loan because my credit rating is low.<br />
I have pulled my credit<br />
i pulled my credit reports and am in shock<br />
World Savings said they would pay of old collections<br />
There is NO RECORD on any of my credit reports that these collections were EVER payed off.</p>
<p>So my credit is still bad because of World Savings failure and now theyre turning me down for home equity line of credit for their own failings!<br />
OMG im about to have a stroke!<br />
what should I do ?<br />
i keep excellent records. im staring at my HUD statement right now.<br />
im just shocked by this catch 22<br />
man Im going to go ballistic on the phone tomorrow morning<br />
my broker was paid 6900 in his fees alone<br />
on my hud is is listing 5405 that was to be paid to the owed creditors (4 total)<br />
only 1 of the 4 shows on my credit report as being payed off</p>

This is governed by CA law since it is a company in California, also what can I do if I send the deposit and sign the contract with the clauses here and they do not decide to give me back my deposit? Thank you.</p>
<p>Borrower hereby retains Commercial Capital as the placer  for the purpose of procuring a mortgage loan approval. Furthermore to obtain a new mortgage upon further investigation of equity, credit, income and title validation.<br />
Commercial Capital acting as exclusive placement agent for borrower will conduct proper due diligence in accordance with ethical business standards to adequately find and place borrower(s) loan request with proper lender. Commercial Capital does not guarantee successful permanent placement of loan, this agreement is for the sole purpose of proper due diligence and best effort for borrower(s).<br />
Borrower(s) agrees to fully comply with document requests relating to loan placement and due diligence needs list requirements for the best efforts to fund loan for borrower(s). Borrower(s) agree to respond with relating documents within 7 days of request to ensure proper streamlining of loan.<br />
Any due diligence fee &#038; packaging fee deposit given to Commercial Capital becomes the property of Commercial Capital wholly earned at the time of payment or collection.<br />
Commercial Capital Promises to use its best efforts to find borrower(s) financing for borrower(s) property. Commercial Capital does not guarantee loan funding within any period of time specified because underwriting guidelines may change from time to time &#038; borrower may not qualify due to loan to value, fico score, or liquidity, debt to income, debt service coverage ratio, or property does not debt service.<br />
Rates fluctuate daily, terms and rates are only approximate until borrower(s) signs the letter of interest from  lender and has submitted all the required paperwork and goes to underwriting for loan approval.<br />
Final rate depends on credit worthiness, dept to income ratio, net operating income, and asset liquidity of borrower(s) &#038; credit risk. Initial rate quote is subject to change by lender. Commercial Capital is not responsible for lender or investor changing rate and will not be held liable or responsible.<br />
Borrower(s) agrees to cooperate fully and submit all requested due diligence information in a timely manner, within 7 days in order to submit to underwriting.<br />
Disclaimer: Rates may change if borrower does not submit within timely fashion within 7 day period.<br />
All submissions must be done electronically. Broker required to submit all due diligence documents electronically.<br />
If referring broker does not send all required due diligence documents within 7 day period it could adversely affect rate which was originally quoted to borrower.<br />
We are advocate of client to use best effort to find investors or lenders which fit into borrower’s request. Subject to underwriter to receive all due diligence material within 7 days otherwise PMD fee is not refundable partially or in full.<br />
This PMD fee is not subject to a refund, an offset or a reimbursement and is deemed earned once received.</p>

We were under the impression that everything is fine and they had to help my husband, because the company was growing so quickly. She had a house that my family moved to and during the month of my law judge. Were evaluated because they are $  400,000. So they decided to remortgage the house to get a loan for the company. She is not qualified because of personal debt for even my husband signed and they signed. It was ultimately not up there working for us so that my family and I moved to Tennessee for a year and paid out of the house and returned everything is fine. They took recently called and told them the company, the IRS and to take all the money from the sale are sold, the mortgage 2 on the house without my husband signed but the bank was under the impression that the papers by fax was a sign &#8211; we had no idea he was going on. They want to bankrupt even have to learn to walk away, and I think we need a lawyer, but I do not know where to start. Any ideas?</p>

It says payment history is Very Good, Ammount of new credit Very Good, Length of credit history just Good, and Amount of debt Not Good. The only thing I have that is a huge debt is my Mortgage which I have NEVER been late on. As a matter of fact I have no late payments on my credit at all. I have one credit card with 750 on it and have a 950 limit,  a joint auto loan owing around 17000, and Home Depot with around 1300 owed on 2200 limit. My Mortgage is 230,000 on a joint loan as well. Please give me your best advice. Should I try to better my score by paying down my cards? Or should I go in now and try to refi?
