Can we have a mortgage company is suing the hell they got us through?
Our company wants us to mortgage the real estate arm to reset fixed mortgages. forclosed and we, in an attempt to sell our house several times Sherriff. Stop with the bankruptcy. We told the court why forclosed on us, but when he sent us the papers for something other than the forclosure was unpaid interest from about 1 yr.prior. Will be able to show interest is paid was not true once we get our bank and phone records. Even tried to make a loan to finance several sectors of our loan by 30 $ , ooo.oo to the fixed exchange rate, but found it was inlawful to buy the house back because they are the same on forclosed. Will now return for the loan $ 70,000.00 to the lowest fixed rate than we want. This solution we hope our credit. I know it sounds ungrateful of us. But hell, they have given us and our children by trying to find housing in our region if not for the schools to change, and unable to car even used cars for sale or to purchase fuel for the oven and our home, and patent my maintaining the children’s sports and grades.
You can sue anyone. Whether you’ll prevail is another question. The reality is that they’ve got more lawyers than you do.

LikeDislikeSorry, you picked the mortgage company and you should have looked over the terms of your loan carefully….you don’t get to sue because you picked a bad plan.
There are alot of exaggerations in your story, which makes me question the validity of any of it.
My advice to you is to take the deal and realize that you can’t afford to look a gift horse in the mouth. If you have filed for bankruptcy and then get a foreclosure it will be 10 YEARS before you can get another mortgage…b/c that will be TWO major financial life events on your credit, and you would be lucky if you could finance a stick of gum.
PS: If your children knew of your poor financial situation, that is YOUR fault, not the mortgage company. No responsible parent allows their children to know that they couldl end up homeless…if you did that to your kids, SHAME ON YOU!

You can sue, but whether you will prevail is a different issue.
BTW, no matter what the lender does, the bankruptcy will trash your credit for 7 – 10 years.
My advice: Take the offer and don’t bother suing. Your chance of prevailing in the situation you describe is about as good as you hitting the Power Ball.
